Can I claim dependency if I am dependent on someone who has not died, but cannot work or provide care due to injury?

Yes – if their injury has impeded their ability to earn effectively, you can claim financial dependency as your income has been affected through no fault of your own.

Your financial dependency claim will fall under a personal injury claim, rather than a claim under the Fatal Accidents Act.

How do I prove financial dependency?

To prove financial dependency, you must be able to substantiate your claim that you were reliant on the injured financially – and because of the injury sustained – you are no longer receiving the same level of financial support.

You can prove this by providing relevant paperwork, such as bank statements, utility bills and shopping receipts, as well as witness statements, accident reports, camera footage and other evidence to support your claim that the accident was not their fault.

How much can I claim through financial dependency?

There is no exact limit to what you can claim through financial dependency, as each case will depend on the extent you depended on the injured before the accident, the amount of money the injured earned before the accident, the extent of suffering received, emotional damages and further compensation if the injury was fatal.
